We are pleased to announce the creation of the “No Whippoorwill Extension” web site ( Its purpose is to share information with residents interested in the efforts to stop this project. They will be adding additional content to the site on a consistent basis so multiple/regular visits to this site are highly recommended. We appreciate your support by signing the already circulating petition, either on the Website, or at the Clubhouse. We urge you plan to attend the County Commissioner’s April 9 meeting where they will consider approving this project. Meeting details will be announced as soon as the agenda is posted.

Landscaping Updates:

Cord Grass trimming and tree/brush removal will begin on the East Berm scheduled 3/25/19.

We are beginning to replace the Indian Hawthorne shrubs, which are beginning to decline, with Podocarpus and Dwarf Ixora (Taiwanese) in the beds located on Livingston Road.  These are hearty plants that will do well in the beds and give this area a new fresh look.  This project with begin 3/25/19.

The next fertilization app (turf only) is scheduled for April 10, 2019.

Dryer Vent Cleaning

Southwest Florida Dryer Vent Cleaning will be cleaning the dryer vents at the condo’s beginning on Monday, April 1st through Thursday, April 11th.  Work will begin cleaning each morning at 8:30am. There will be 2 technicians cleaning at the same time. Please refer to the schedule below to see when your building is scheduled. Cleaning time for each unit is expected to be 20 minutes. Prior to the technicians’ arrival, please clear the laundry area so the technician will have room to work. Work should be completed each day by 12:00pm.

Grills & Fire Code Requirements- revised

Last week, I erroneously sent out the old rules for grills and fire codes.  They were updated Jan. 2018 which allows for electric portable grills not to exceed 200 sq. inches of cooking surface.   You Can download a copy of the fire code requirements on the website ( which is located in the forms and documents section.

Subject: Storage and Use of Gas Fired, Electric or Charcoal Fired Cooking Grills

The North Collier Fire Control and Rescue District Enforces the Florida Fire Prevention Code NFPA 1 2015 edition-Chapter 10 General Fire Safety. Section 10.10.6 reads as follows:

10.10.16 Cooking Equipment: For other than one and two family dwellings, no hibachi, grill, or other similar devices used for cooking, heating, or any other purpose shall be used or kindled on any balcony, under any overhanging portion, or within 10 ft. (3m) of any structure.  Listed electric portable, tabletop grills, not to exceed 200 square inches of cooking surface or other similar apparatus shall be permitted.  For other than one and two family dwellings, no hibachi, grill or other similar devices used for cooking shall be stored on the balcony.  Listed equipment permanently installed in accordance with its listing, applicable codes and manufacturers instructions shall be permitted.

Storage of LP gas cylinders shall meet the requirements of NFPA 58 Liquefied Petroleum Gas Code 2014 edition Chapter 8 – Storage within residential buildings.

8.3.5 Storage within Residential Buildings:

Storage of cylinders within a residential building, including the basement or any storage area in a common basement or a multiple family building and attached or detached garages shall be limited to cylinders each with a maximum water capacity of 2.7 lbs. (1.2 kg) and shall not exceed 5.4 lbs. (2.4 kg) aggregate water capacity per each living space unit.

8.4.1 Location of Storage Outside of Buildings:  Storage Outside of Buildings

For cylinders awaiting use or resale or that are part of a cylinder exchange point shall be located as follows:

  • At lease 5 ft. (1.5m) from any doorway or opening  building frequented by the Public where occupants have at least two means of egress as defined by NFPA 101, Life Safety Code
  • At least 10 ft. (3m) from any doorway or opening in a building or sections of a building that has only one means of egress.

Failure to correct violation may result in:

  • Mandatory notice to appear or issuance of a citation that may result in fines up to $500.00 and the costs of prosecution. OR (2) Code Enforcement Board review that may result in fines up to $1000.00 per violation, as long as the violation remains, and the cost of prosecution.
